Minutes of the meeting held 18th December 2006

Minutes of the meeting held 27th November 2006 were amended, agreed and signed by the chairman.

73.0 CHAIRMAN’S ANNOUNCEMENTS
The Chairman asked for a vote of thanks to Cllr Latchford for organising Christmas lights for Station Road. Agreed.
Warden Liam Doogan gave thanks to Cllr Cohen for his kind words in a local newspaper. He then gave a summary of issues that had been dealt with stating that car related and Highways issues gave on average 5 problems per month each and cleansing resulted in approximately 10 concerns per month. Anti social behaviour had dropped dramatically with no reported problems from the Recreation Ground recently. The Wardens had played an active role in reassuring residents that the youth at the Square were not a threat to public safety and the area has improved. The removal of a memorial bench from the churchyard had helped ease the youth problems and it is hoped that the removal of a stone bench will further improve the situation. Graffiti remains a problem Thanet wide but is showing signs of improvement in the Birchington area, with an incident at Minnis Bay still under investigation. PC Weston stated that the telephone boxes had not been damaged since their refurbishment. Cllr Cohen confirmed that their appeared to be a greater presence of Wardens and police, particularly off the main Roads which was improving the Village as a whole. Cllr Latchford re-iterated thanks for the co-ordinated approach to making Birchington a safer community. Cllr Francis confirmed that the PCC had agreed to move the stone bench but as it would cost £500, fund raising needed to be done before its removal could be actioned. The Wardens were asked about the activities of the Youth Worker and it was felt that as youth problems had decreased, the employment was helping. Cllr Pepper also gave thanks for the work of the Wardens and PC Weston. Warden McDonald introduced himself and explained that he covered Birchington South 2 days per week plus the villages of Acol, St Nicholas and Sarre.

74.0 REPORT OF DISTRICT COUNCILLORS
Cllr J Cohen
Cllr Cohen raised concern over the state of Albion Road car park stating that it had rubbish problems. Cllr Latchford replied that the contractor had been told of the concerns, and an additional waste bin was to be placed near the recycling bins plus enforcement had visited the site twice recently re fly tipping but unfortunately no prosecutions could be made.
Cllr R Latchford
Serco had kindly loaned Christmas lights to the Village and the cost to the Parish Council would be approximately £41 in electricity for the period, which it is hoped will be reimbursed by Members Grants. Cllr Latchford reminded the PC that there were still funds available from the Members Grants.
75.0 KCC COUNCILLOR REPORT
The annual settlement from Central Government remains unchanged meaning less money than last year. Education and Adult Social Services are ‘ring fenced’ allowing for inflation so other services will be effected especially Highways.
The White Paper has been issued and submissions are invited from local government.
More work has been carried out to rectify the puddling on the footbridge by the Station but the final tarmac layer cannot be laid until there is drier weather.
Cllr Francis reported a fall by a MOP on the bridge due to uncompleted work.
76.0 CLERKS REPORT
Items of correspondence were detailed including: a phone call from the Chief Executive office acknowledging receipt of complaint letter but requesting more information. Letters from Highways regarding proposed parking restrictions – it was agreed that further information was required for two of the proposals.
There was discussion on closing of footpaths and the Clerk was asked to request a copy of the definitive list which has recently been compiled by KCC and chase a response re Yew Tree Gardens footpath.
The Clerk asked for the forthcoming Planning meeting to be brought forward time wise as she had an evening commitment.
77.0 MEMBERS REPORTS
Cllr M Pepper
Cllr Pepper had reported several issues regarding potholes and lights direct to Highways.
Cllr J Francis
The pot hole in Minnis Road has been repaired. There has been some confusion by residents following the delivery of the wheelie bins as some are missing the explanation documents. Cllr Latchford agreed to give Cllr Francis several copies to give to concerned residents. A car was apparently abandoned in Hereford Gardens causing problems, but has now been removed. The allotments on church land are likely to be purchased by TDC.
Cllr I Bedwell
Albion Road car park in need of a sweep and drain clearance. Cars continue to park on the grass by the Hoardings in Canterbury Road – PC Weston agreed to monitor the situation. The plans for bollards cannot be progressed until the land dispute is settled.
Cllr P Vilton
Thanet Safe is working well with 20 members.
Cllr R Latchford
4 new mature trees have been planted at Minnis Bay. Former Cllr Frank Fox had passed on praise for the amount of support shown at La Chappelle on Armistice Day. A new toilet in Albion Road car park would cost the PC approximately £4,500 mainly in cleaning costs. A neighbour is complaining about a derelict building on the Parade – it is thought that the property had planning approval for redevelopment as flats. There was large scale vandalism at the Station end of last week – Transport Police dealing with the matter. A resident has complained about speeding in Park Lane – information on Speedwatch passed to him. The toilet at Beresford Gap is to be refurbished following a grant allocation.
78.0 COMMITTEE REPORTS
Finance Committee
The list of payments was circulated and agreed. There were 9 payments totalling £2,303.17 plus income of £2078.25 from VAT refund and Quex Park donation. The proposed budget agreed at the Finance meeting had been updated following answers to queries and Cllr Garland proposed that the precept be set at £30,696 for 2007/08. 2nd by Cllr Latchford. Agreed.
Parks: No new items to report.
Projects: The Christmas light project would be progressed at the end of this season and possibly extended to include Dog Acre and floodlighting. The LED downlighters would be further considered as very effective. Quotes on upgrading the hard drives for the CCTV system are still awaited. It was agreed at Finance meeting that the hanging baskets would not be considered at this stage due to the costs involved.
Publicity: Cllrs Garland and Pepper will attend the January surgery.
Planning Committee
The forthcoming meeting was altered to a 3pm start as there are now 9 new plans for consideration. The Clerk was asked to write to the Heritage Trust and the Conservation Officer and request a meeting
To discuss extending Conservation area or the Area of High Townscape Value to protect prime properties from future development.
79.0 REPORTS FROM VILLAGE ORGANISATIONS
TAPC – Cllr J Francis
The next meeting is planned for end of January.
Twinning Association – Cllr B White
The next meeting is to be held on January 16th, the carnival selection to be made on 3rd February in France and the AGM is to be held on February 20th.
PCC – Cllr J Francis
Cllr Francis was unable to attend the most recent meeting but minutes would be forwarded.
Youth issues – Cllr J Garland
New volunteers had been found and funding was sufficient for the moment.
80.0 OTHER MATTERS ARISING
Cllr Bedwell gave thanks to the Councillors attending the scattering of the late Alf Bedwell’ ashes. His memoire is to be published in the New Year.
Cllr Hibberd reminded Council that Community Grants are still available – Cllr Garland to approach the Scouts at a forthcoming meeting..

63.0 CHAIRMAN’S ANNOUNCEMENTS
The Chairman has expressed the PC concern through Manston Parish Council, on the proposed scale of house building at Westwood Cross. Members may also make individual comment to TDC Planning Dept. There has been no further news on the Silver Band rent dispute or the Primary School improved sports facilities.
Mr Michael Bates from TDC joined the meeting to demonstrate LED lights, which are very effective but low energy using. LED Christmas lights were discussed but Mr Bates confirmed that they could not be delivered in time for this Christmas. Mr Bates also asked the PC to consider other projects they may wish to undertake as part of the TDC Environmental Action programme as funds are available for suitable projects. It was agreed that a list would be compiled for consideration next year. Mr Bates will be viewing Station Road in the New Year under the above programme and will liaise with the PC.
A resident wished to bring to the PC attention concerns regarding the speed of traffic and inconsiderate parking in Essex Gardens, particularly at the Canterbury Road junction. The PC was asked to consider parking restrictions on the corner enabling easier access from residents drives, and clearer signage indicating the 30mph speed limit. It was agreed that the Clerk would request a meeting with Highways and the resident would also be invited. Cllr Hibberd commented that residents on the corner of Kent Gardens and Canterbury Road had identical concerns.

64.0 REPORT OF DISTRICT COUNCILLORS
Cllr M Sheldrick
No items to report. Cllr Sheldrick is taking a ‘backseat’ for health reasons.
Cllr J Cohen
Cllr Cohen had received notice of an application for a telecom aerial at Quex Park. There was initial concern over the proposed position due to its proximity to residential property. Cllr Cohen raised an objection. The Clerk reported that she had received a letter and maps showing a revised proposed position. It was agreed that the matter be deferred to Planning Committee.
65.0 KCC COUNCILLOR REPORT
Following the introduction of the Childrens Act, there are no plans at present for Childrens Centres in Birchington. Social Services has been reorganised and services centralised in St Peters, with the Minnis Road centre to close shortly for redevelopment. The decision is awaited on the proposed reorganisation of Kent Highways. There is no further news on the petition to re-open the path at Yew Tree Gradens, and there has been an application for the closure of a footpath between Sewell Close and Park Lane due to anti social behaviour. KCC Community Grants will be finalised at the end of January and it is hoped that the requested funds for the provision of the youth worker will be granted. Cllr Garland thanked Cllr Hibberd for his report and asked the Clerk to write to the PROW office for an update on the Yew Tree Gardens path closure.
66.0 CLERKS REPORT
Items of correspondence were detailed including: Letter from a resident regarding the puddle which remains on the Station Approach footbridge, letter from a resident regarding the removal of benches on the coastal path, towards Reculver. The reply from Cllr White with regard to the PC complaint was copied to all Members. It was agreed that a letter be written to the Chief Executive – Chairman and Clerk to liaise.
67.0 MEMBERS REPORTS
Cllr M Pepper
Cllr Pepper asked the Clerk to chase news on the parking restrictions planned for Kent Gardens. Parking on the verge in Canterbury Road continues to be a problem, despite the Wardens and Highways having been informed – Cllr Garland agreed to speak to Police. It was suggested that the kerbstones could be raised to deter the inconsiderate parking. Cllr Pepper asked for an update on the provision of trees by the medical centre – the land owner has been written to and the Clerk to ask TDC if they have any spare trees.
Cllr B White
A directional road sign in Canterbury Road by the Church pedestrian crossing has been hit and is in need of repair. The blocked drain outside 44 Kent Gardens now has weeds growing and the gaps in the road surface of Canterbury Road between Tudor and St James remain – the Clerk gave an update as Highways consider the surface to not need repair at present but that they will be monitoring its condition. Cllr White requested a site meeting with Highways.
Cllr J Francis
The pot hole remains in Minnis Road and Albion Road also has large potholes. The minutes from the Parish Forum meeting have been received and the item regarding planning site visits will be deferred to the Planning Committee.
Cllr P Vilton
There are now 20 members of Thanet Shop Safe and the scheme is working well.
Cllr M Sheldrick
Residents of Ferndale Court wish to have a footpath closed due to anti social behaviour – there is to be a meeting to discuss the issue. The dangerous branches on a tree in Green Road have still not been cut back.
Cllr J Cohen
Commented that the Youth Worker and Wardens doing a superb job, covering a wide area of the Village.
Cllr D Cooper
Agreed with Cllr Cohens comments. A short history of the fountain in the Square has been compiled with the help of the Residents Association and passed via the Clerk to a resident querying why the lantern on top is not lit.
68.0 COMMITTEE REPORTS
Finance Committee
The list of payments was circulated and agreed. There were 10 payments totalling £2,681.50. A budget meeting was agreed for December 13th following PPP meeting.
Parks: Some more plants have been stolen. A panel is missing on the teen shelter.
Projects: Thanks were given to Mr Bates - the Committee will consider items which could be included in the scheme next year. The CCTV cameras have still not been connected to the Margate operations room – Cllr Cohen agreed to chase the matter.
Publicity: The winter newsletter is out and being distributed. The Cemetery bus is running well and an advert link is being considered for the website.

Application TH/06/1173 Parkstone, Epple Bay Road has been withdrawn.
69.0 REPORTS FROM VILLAGE ORGANISATIONS
Neighbourhood Watch – Cllr D Cooper
The Annual meeting of Thanet NW was held with Superintendent Joanna Young in attendance. All Officers were re-elected, but with a new Secretary. The newsletter is being distributed.
TAPC – Cllr J Francis
The rules on planning site visits was discussed.
Twinning Association – Cllr B White
A trip is being organised for February 3rd to attend the carnival court selection. The next meeting is on January 16th and the AGM will be on February 20th. Comments regarding the number of people travelling to France will be addressed at these meetings.
KIACC – Cllr J Garland
Contact has been made with the new Chairman but there is no further news to report.
TRRG – Cllr J Garland
Some other areas are considering joining the rural speed watch scheme. Birchington remains uninvolved.
PCC – Cllr J Francis
Meeting held in October. Finance is a concern as collections are not covering the costs – fund raising is being considered.
Youth issues – Cllr M Sheldrick
More volunteers have been found to help at the Youth Club, subject to police checks.
70.0 OTHER MATTERS ARISING
There is rumour that some land currently having allotments upon it may be sold. It was thought that regulations protect the continuation of the allotments in these instances. The Clerk was asked to obtain a copy of the recreational space audit.

53.0 CHAIRMAN’S ANNOUNCEMENTS
The Chairman reported that the Silver Band is still considering future use of the Band Hall following a rent dispute and a meeting with the Hall owner and solicitors is to be arranged. The owner of land in Canterbury Road has been in contact with the Chairman regarding the plans to place bollards at the site. An update was given. There is to be a meeting on October 31st at Park Lane Primary School regarding development of sports facilities – Chair and Vice Chair to attend.

54.0 REPORT OF DISTRICT COUNCILLORS
Cllr M Sheldrick
The land dispute at Mill Row continues. The revision of the definitive map of public rights of way is underway and some paths have been highlighted as needing inclusion/exclusion. Cllr Sheldrick attended the opening of the new RSPCA shop. Cllr Sheldrick commented that the press where not highlighting the fact that recycling targets were set by Central Government and TDC will be fined if targets are not met.
Cllr R Latchford
A new toilet for Albion Road car park is still under consideration by TDC but may have to be funded by 2007/08 budgets (Cllr Garland commented that full charges to be incurred by the PC will have to be known before a decision is made). The funds are available to place power points on 16 streetlights in Station Road but KCC has raised concerns over the suitability of the lights on our posts, and have not yet given permission. Alternative LED lights are now being considered.
Cllr J Cohen
Cllr Cohen commented that the Weekly Planning List supplied by TDC had out of date information with regard to Parish Wards. A green waste collection is still not available in certain areas of Birchington, and Cllr Cohen was dissatisfied with the answer given by the TDC Officers.

The item was deferred until Cllr Hibberd arrived.
56.0 CLERKS REPORT
Items of correspondence were detailed including: Confirmation from TDC that the trees needing trimming in Station Road had been reported to KCC. A letter was received from a resident thanking the PC for arranging the removal of a parking bay in Albion Road which was causing sightline problems.

A number of outstanding highways issues were again reported to the Clerk. Cllr White also reported that paving is needed at the entrance to the play areas as they were very muddy.
Cllr M Pepper
Cars continue to park on the verge in Canterbury Road, between Kent Gardens and the roofing company. Cllr Garland agreed to inform the Policeman and Wardens and the Clerk to write to Highways. Cllr Pepper to forward to the Clerk the report number for the trimming of trees in Station Road, which was reported many months ago. The Clerk was asked to pursue the planting of trees at the Doctors surgery.

Problems at Brooksend have now been rectified.

Had a letter from Christies addressed to Cllr Francis – to be forwarded.

The tree outside 12 Green Road is still in dangerous condition.
55.0 KCC COUNCILLOR REPORT
The awaited White Paper was issued today and will have implications for Parish Councils and local government. Kent Highways is to re-organise again with some centralisation of staff envisaged. The campaign regarding the imbalance of County Council funding between the South East and other more Northern Counties continues, and it is hoped that a meeting with the Treasury can be arranged. Boundary changes are also under consideration and may result in reduced boundary areas. The library has re-opened with upgraded services including improvements to childrens services. A noticeboard for the PC use has been installed, and Cllr Hibberd would welcome feedback from the PC. There is still a problem with puddles on the footbridge by the Station despite re-surfacing work. A number of grants are available for Parish Council use.
58.0 COMMITTEE REPORTS
Finance Committee
The list of payments was circulated and agreed. There were 13 payments totalling £10,092.13, which included £2,500 for the outreach worker and £4999 for new playground equipment. £15,000 half precept has been received.
Parks: The planters have been planted with winter plants, but one has already had plants stolen. The gaps in the matting at Crispe Park still need to be filled.
Projects: Christmas lights and improved CCTV systems being looked at. Hanging baskets have been deferred due to costs. The Shopsafe scheme now has 14 members but requires 1 more to meet the minimum requirement.
Publicity: The cemetery bus ran as normal. There is space in the Newsletter – Cllr Latchford was asked to provide an article on graffiti. Cllr Bedwell and Cllr Latchford to attend the library surgery on November 4th.
Planning Committee
The Cranworth and Wyndcliffe proposal was refused at TDC Planning Committee. Modifications are expected on the Christies application, and this will probably delay its determination at TDC Planning Committee. Cllr Cohen asked if the letter from Christies could be copied to all Councillors. It was agreed that the decision should be made by Cllr Francis as it was addressed to her personally.

The Annual meeting was held with the Village Policemen in attendance.

A Chairman was finally appointed at the meeting held on October 12th.

Minster PC is still considering leaving the group.
Youth issues – Cllr M Sheldrick
There is to be a meeting on November 3rd. Cllr Sheldrick has written an article for the Forum and Round-a-bout asking for information on youth activities, so that a definitive list can be compiled.
60.0 OTHER MATTERS ARISING
Cllr Sheldrick attended the march against the closure of post offices, which will include the Minnis Bay post office. The PC confirmed its support against the closure.
Cllr Latchford reported that the Secretary of the Conservative Group is visiting organisations giving a non-political presentation on the activities of TDC over the last four years. It was agreed that the Centre would be a better venue than the PC Office as it has a larger audience capacity.
Cllr Hibberd asked if the PC would be taking part in the Remembrance Sunday parade. The Chairman confirmed that Councillors will attend and there will be the usual reception at the Centre afterwards. Cllr White commented that the Birchington Parade is never covered by the local newspapers.

41.0 DECLARATIONS OF INTEREST: None.
42.0 CHAIRMAN’S ANNOUNCEMENTS
The Chairman welcomed the guest speakers and the Community Wardens. The Chairman drew Members attention to the Standards Board leaflet on Dual Hatted membership, copies of which had been circulated by the Clerk. Some Youths had been apprehended by the Wardens and Police in connection with anti social behaviour. The third Parish Forum meeting is to take place on the 26th September with the Chairman and Clerk attending.
43.0 GUEST SPEAKERS
A comment was made on the improved condition of the Rossetti Garden and the problems which are occurring in other public areas of Birchington, but appear to have diminished at Rossetti. The Chairman confirmed that the Parish Council would be deciding on the application TH/06/1000 Christies wine bar – change of use to beer garden, at the Planning Committee meeting to be held 27th September.

44.0 REPORT OF DISTRICT COUNCILLORS
Cllr M Sheldrick
Cllr Sheldrick has been unwell and had been tiding work over.
Cllr R Latchford
A series of Roadshows are being held throughout Thanet.
The consultants report on the Theatre Royal has concluded that if some changes are implemented it will continue to operate.
A number of youths are on bail following criminal damage charges.
The TDC Planning Committee recommended a site visit and intent to refuse the development at Cranworth and Wyndcliffe, The Parade.
Cllr J Cohen
Cllr Cohen continues to be concerned at the erosion of democratic rights over determining the licence for Christies wine bar. As a result he has resigned the Conservative whip and is now an independent Member at TDC.
45.0 KCC COUNCILLOR REPORT
Cllr Hibberd stated that all County Councillors have been instructed to attend Parish Council meetings, to improve community liaison.
KCC is at deadlock with central Government regarding national grants being unfairly distributed, and a campaign for a standardised formula is about to start. The PC confirmed that it supported the campaign. The publication ‘2010’ has been distributed to households, giving the vision for KCC over the next four years. Community grants are still available from KCC. A consultation is taking place on footpaths and ROW and one objection has been received regarding a path at the Recreation Ground. It is hoped that the ponding problem at the railway bridge will be sorted by contractors currently installing new safety barriers. All schools are being encouraged to take a pro-active approach to community issues. There is no further news on the footpath concerns at Yew Tree but it is believed that the action group has submitted new evidence. The PC should be involved in the subsequent consultation process.
46.0 CLERKS REPORT
Items of correspondence were detailed including: Correspondence regarding Christies wine bar, an invitation from the Mayor of Margate to attend My Fair Lady production (Cllr Vilton to attend), and a fax from the Parks Manager regarding the trees in Station Road which are in need of trimming.
47.0 MEMBERS REPORTS
Cllr B White
There are gaps in the road at the bottom of Hereford Gardens, the gaps remain in Canterbury Road and the drain is still blocked in Kent Gardens.
Cllr J Francis
Cllr Francis has been asked if residents can paint white lines on the road in front of their drives to stop inconsiderate parking. It was thought that this would not be allowed and residents must approach Kent Highways.
Cllr I Bedwell
Rubbish was cleared very promptly after making a report to Streetline.
Cllr R Latchford
TDC has confirmed that the CCTV system will be linked to the main operations room. Cllr Latchford asked if the CCTV traders contribution bank account needed closing. Cllr Cohen replied that the account had not been activated.
Cllr M Sheldrick
Reminded Council that £5,500 funding is still available and must be spent. Plugs on the streetlights is being considered as a possible project. A number of messages of thanks for a less troubled summer have been received and passed to the Wardens.
Cllr P Vilton
A ‘lively’ Thanet Safety meeting was held to discuss the introduction of the shop safe radio system. Despite 40-50 traders attending only 5 gave their support. Traders will be visited individually in the hope that the system can still be implemented. A mini bus is to go to La Chappelle on November 11th, and there are 4 spare seats at present.
48.0 COMMITTEE REPORTS
Finance Committee
The list of payments was circulated and agreed. The last meeting dealt with Landlord issues but a further meeting is needed as an application for funding has been received. It was agreed that this would be held on Wednesday after Planning.
Parks: The internal gate at Crispe Park has been mended, but there is more graffiti on the play equipment.
At the Recreation Ground – the graffiti board has now been moved but the grass still needs cutting inside the play area. An additional bin is needed at the Peter Francis Memorial Ground. There has been no maintenance carried out at the War Memorial.
Projects: Confirmed that the CCTV is to be linked to the main control room but the implementation may take some time. Quotes for hanging baskets have been circulated and will be considered at the next Committee meeting.
Publicity: Cllr Garland suggested that an article on the CCTV system and its success should be included in the next Newsletter.
Planning Committee
The next meeting is to be held on the 27th when Christies application will be decided along with 6 other plans. Cllr Cohen has called in the application for 22-24 Station Road – the Clerk gave a copy of the decision notice for the previous application to Cllr Cohen.

Birchington Residents Association – Mr R Walford
Unfortunately Mr Walford is unable to attend the Planning meeting on the 27th but wished the Committee to consider two letters of objection and some historical information. Mr Walford also stated that he had a petition containing 84 signatures. The information was passed to the Clerk.
Twinning Association – Cllr B White
The gourmet trip went well. A joint meeting between France and Birchington is to be held on Sept. 30th – three Councillors confirmed they would attend. Cllr White wished to remind members that attendance on trips should be booked through the Twinning Association.

There is to be a meeting on October 12th at which the new Chairman should be decided.

32.0 CHAIRMAN’S ANNOUNCEMENTS
On behalf of the Parish Council, the Chairman gave condolences to Cllr Bedwell on the loss of Alf. A minutes silence was held.

O2 are offering up to £1000 grant to environmental community projects.
Letters have been received from the Landlord in respect of the Office rent and water supply. The Clerk was asked to agenda a Finance Committee meeting to discuss the matter.
The newly employed outreach worker has contacted the Chairman and agreed to provide a progress report before the year end.
The Chairman of the Residents Association wished to know the Parish Councils views on planning application TH/06/1000 – change of use of Rossetti Garden to a beer garden for Christies Wine Bar. He raised the issues of tables being placed before planning permission sought, notices on the wall, the removal of a table and when planning permission was granted for the side door to the building. Cllr Francis replied that the application would be formally discussed at the Planning Committee meeting to be held on 6th September. Cllr Cohen stated that the PC was not just considering the planning application but also the infringements of the licence issued by TDC. He felt that the change of use would by contrary to the open spaces policy within the Local Plan and due to the infringements, TDC should be requested to revoke the licence. Cllr Garland confirmed that the PC was unaware of planning permission having been granted for the side door, but that it had been in place for many years.
Another member of public read a statement from the Carnival Association, saying that whilst the carnival was successful the day was marred by the Chairman declining the hospitality offered by Christies. The Chairman replied that he fully supported the Carnival but the offer of hospitality put him in an impossible situation. The invitation also arrived very last minute – apologies were given for this. Cllr Bedwell stated that gifts had been arranged again this year but she was unable to present them. The removal of a bench from the garden was explained by a member of public.

Quiet as holiday time but has been reviewing the forthcoming Gambling Act and some licensing issues have been dealt with.
Cllr J Cohen
Cllr Cohen expressed his disappointment at the police and TDC response to an incident involving mini motorbikes at Minnis Bay on August 30th.
Objections and 1 call in support have been received regarding TH/06/1000. Cllr Cohen stated that a letter from TDC dated August 11th declared that a process to cancel the licence issued to Christies would start as there were continued infringements. The Chairman passed a copy of a letter received on August 21st to Cllr Cohen which states that as planning permission has now been sought, the cancellation process had been stopped.
Cllr Cohen proposed that the PC write to Mr Brian White and tell him that Council does not agree with recent letter but does agree with the letter of August 10th commencing cancellation of licence.
Motion lost.
Cllr Cohen further proposed that we write to Brian White stating that the Parish Council is against the content of the letter dated 21st August 2006 instructing staff to suspend the cancellation of the licence (paragraph 2). Vote taken. 3 for, 1 against, 2 abstained.

There have been many complaints regarding the condition of the phone boxes in The Square. Cllr Sheldrick has requested KCC sort the problem with puddles on the footbridge while the bridge repairs are being carried out.

A resolution to oppose the house building at Westwood Cross has been made by Manston PC and forwarded to BPC. Cllr Garland proposed that support be given to the draft resolution. 2nd by Cllr Francis. Agreed.

Parks: New play equipment is ready to be installed at Crispe Park and the Recreation Ground.
Projects: The maintenance contract for the CCTV system has been agreed and the company has given advice. The second audit of the system has started. Cllr’s Cohen, Sheldrick and Latchford were urged to approach TDC with regard to connecting the system to the main control room. Cllr Cohen gave thanks to the Chairman and Cllr Cooper for the hard work they continue to give to the CCTV project.

22.0 CHAIRMAN’S ANNOUNCEMENTS
There is to be a public meeting organised by Manston PC to discuss the proposed development at Westwood for 1000 houses without road improvements. CPRE are involved.
PC Chris Bungard introduced PC Tim Weston as the new Village Constable. PC Weston confirmed that a public surgery will continue to be held on Tuesday mornings in the Council Office.
A member of public raised the issue of increased graffiti in the Village, most bearing a recognised identity tag. PC Weston replied that the Police were aware of the problem and cars had also been vandalised and written on. Brills Hardware had been visited and agreed to no longer sell spray paint. Cllr Latchford commented that TDC had an active Environment Action programme to clear graffiti but the problem was now so severe, that they were having to prioritise the cleaning process. Covert CCTV cameras were now covering known areas with some success.

23.0 REPORT OF DISTRICT COUNCILLORS
Cllr J Cohen
The teen shelter is still causing problems with anti social behaviour and some cars in the vicinity had been vandalised. A further meeting to discuss the shelter is to be held August 8th. Balls are being kicked against fences surrounding the Recreation Ground.
There is no further news regarding the closed footpath at Yew Tree Gardens.
The planning application at Brent House has been refused.
Christies wine bar is still acting in breach of its licence by not applying for planning permission and by having an extra table in the Garden.
Cllr R Latchford
Cabinet has agreed the Community Projects Allowance to District Councillors of £1000 per Councillor but it will end in January 2007 with unspent money no longer available after this date. Birchington has £6500 available from the fund, unspent.
Vandalism is now a huge problem for Thanet and covert CCTV cameras are being used to help catch culprits. £15,000 has been spent on cleaning graffiti so far this year.
Toilet refurbishment continues.
Various outstanding Highways matters have been chased and the Cleaner Greener Thanet promotion launched.

24.0 KCC COUNCILLOR REPORT
Cllr Hibberd was unable to attend as he was at another meeting. Cllr Garland reported that the Yew Tree Action Group is still waiting legal advice, but a meeting has been arranged between the Action Group and KCC for September.
It was agreed that the notice board in the Library does not work for displaying Parish Council notices and the Clerk was asked to write and ask for an alternative or better signage.
25.0 CLERKS REPORT
Items of correspondence were detailed including: copies of the Kent Policing Plan and a reply regarding the maintenance of the war memorial. The Clerk requested that BPC purchase a copy of the latest Local Council Administration book at a cost of £51.95. Agreed.

Cllr M Pepper
The Kent Gardens street sign has been returned. The proposal for extended parking restrictions in Kent Gardens has been delayed as there were some objections to the scheme. The problems with the Library notice board already covered in item 24.0 above.
Cllr B White
The previously reported gaps in the tarmac in Canterbury Road are getting wider, but have been marked for repair. The drain outside 40 Kent Gardens remains blocked.
Cllr J Francis
There is a rumour that residents in Hereford Gardens are asking for a one way system to be considered.
It appears that the church may own some land currently under an ownership dispute at Mill Row /Canterbury Road.
Cllr I Bedwell
The Chairman welcomed Cllr Bedwell back after a long period of illness.

The planning application at 10 Shakespeare Road has been refused, further curtailing the expansion of children’s homes in Thanet.
Cllr R Latchford
An opposition group to the proposed Cranworh and Wyndcliffe development has consulted with central Government.
An excellent Quex Prom was held and the Birchington carnival queen gave an address.
Cllr P Vilton
It is hoped that a mini bus can be arranged for the Armistace Day trip to France.
Cllr Vilton is pursuing the setting up of a Traders Association. The shop safe radio system is likely to be re-introduced to Station Road.
Cllr D Cooper
The new industrial size bins at Minnis Bay have made an improvement to the cleanliness of the area, but suggested that one should be placed in the car park to serve the grass area around the pub.
A rock band was playing outside the Minnis on a Sunday afternoon which caused lots of complaints about the noise. The Clerk was asked to write to TDC about the incident and enquire if a licence is held for outside entertainment and for the number of tables and chairs being used. Cllr Latchford agreed to liaise. Cllr Bedwell stated that Songs of Praise will shortly be broadcast from Minnis Bay. The Clerk was further asked to write to TDC and enquire as to the status of the grassed area in front and to the side of the Minnis PH.
27.0 COMMITTEE REPORTS
Finance Committee
The list of payments was circulated. There were 12 payments totalling £2,055.64 Agreed.
27.1 Rent review: The Clerk gave details of a telephone conversation she had with the Landlord. He proposed that a new rent review is sort from Rogers & Hambidge who had previously given a suggested rental value. The findings would then be agreed to by both parties. Cllr Garland proposed that the Landlord seek advice from Rogers & Hambidge regarding a current rental value of the Council Office. 2nd by Cllr Cohen. Agreed.
27.2 Outreach Worker: The Finance Committee had considered the employment of an outreach worker for an initial period of 6 months at a cost of £2,500 with a further cost of £2,500 should the contract be extended to 12 months. As this cost was not budgeted it was brought to Full Council for ratification. Cllr Garland proposed that an out reach worker be employed for three hours three times per week for a period of six months funded from contingency funds or TDC Community Projects funding at a cost of £2,500. 2nd by Cllr Latchford. Agreed. It was noted that should the contract be extended, funding may be available from KCC for the additional cost.
PPP Committee
Parks: A report from TDC on new equipment for Crispe Park is still needed. Some plants have been stolen from two planters. The kick wall has not yet been moved to the teen shelter. A quote from Thanet Stone regarding maintenance of the war memorial has not yet been received.
Projects: The Committee is considering new seats, tree planting and hanging baskets. Two quotes have been received for annual CCTV maintenance and Committee had agreed that Coastal Security should be awarded the contract. Agreed.
Publicity: The July newsletter is being distributed. The website is being used more including the email facility. The Cemetery Bus timetable is now advertised on the notice boards.
Planning Committee
A planning application from 2004 for Christies Wine bar shows a rear door onto Rossetti Gardens as existing.
Full plans on the proposed development at The Waves, Hengist Road have still not been received although an A4 sheet copied from the internet was faxed to Cllr Francis from TDC. The Clerk and the Chairman has requested that TDC hold the application until precise drawings and plans are received. Cllr Latchford confirmed that the application had been called into TDC Planning Committee.
As above, plans have not been received regarding the proposal for Cranworth and Wyndcliffe. The Chairman stated that a questionnaire is being circulated by the applicant. The Clerk confirmed that the properties are in an area of designated High Townscape Value.
The Clerk stated that she was unable to attend the next Planning Committee meeting scheduled for August 9th. It was agreed that it be held on August 10th instead.

11.0 CHAIRMAN’S ANNOUNCEMENTS
On June 30th there is to be a meeting with the Thanet Safety Partnership and other bodies to discuss a way forward with regards to the Teen Shelter at the Recreation Ground. The Chairman also reported that he had a request from the Police and the Community Wardens for Parish Council views on the locking of the churchyard gates at night and the removal or locking of the telephone boxes in the Square. This is in response to anti social behaviour. There were no objections to the locking of the churchyard and the telephone box request was deferred to the Planning Committee.
There were a number of residents from properties close to the Recreation Ground, complaining about the problems with the teen shelter, mini motorbikes and other anti social behaviour affecting them. They asked the PC to consider removing the teen shelter. The graffiti board was also discussed. The Chairman responded by stating the meeting (mentioned above) is to have police and other organisations present including resident representatives so that a decision on the future of the teen shelter can be made. Cllr Latchford commented that more public need to report issues and inform the Council if names are known so that ASBO’s can be issued. Cllr Cohen stated that the police where very aware of the problems and making investigations. The Chairman concluded with the comment that the land is controlled with by-laws which need enforcing by TDC, the land owner.

12.0 GUEST SPEAKERS – Mr Mervyn Davey & Mr Charlie Mara, Ursuline College.
Mr Davey read a report giving details on the background, description and aims in being accredited Specialist Sports Status, which was achieved in 2004. This includes a School Sports Partnership scheme, linking Ursuline College with other schools and the community. The aims are to increase facilities, encourage access and support and equip users. A new sports hall is being built and improvements are now needed for on-site grass facilities. Discussions with Quex Park Estates resulted in the acquisition of 19 acres of land, and a planning application was submitted. Unfortunately due to residents concerns regarding the access to the site, the application had to be withdrawn. This resulted in some funding being withheld as certain criteria was no longer met and the current planning application has had to be on a smaller scale and without facilities for local community use.
A question and answer session was held. It was agreed that the Parish Council fully supports the scheme and that a suitable access point must be found to allow the original scheme to go ahead, allowing community use. It was further agreed that the facilities would be a great asset to Birchington. Access via the health centre track was suggested. The session concluded with Cllr Latchford stating that he would endeavour to organise a meeting with KCC and TDC planners in the hope that an access solution could be found.

13.0 REPORT OF DISTRICT COUNCILLORS
Cllr M Sheldrick
The Gambling Act will take effect in September 2007, a consultation process is in place. Anti social behaviour being taken very seriously, with two applications for taxi licences turned down due to the unsuitability of the applicant.
Cllr R Latchford
All households in Birchington should shortly receive letters regarding the wheelie bin scheme being introduced to the Village in November, which will include the opportunity to register bin requirements, special needs etc. Industrial bins are to be placed at the beach bays and a ‘clean Thanet’
poster campaign will coincide. The main beaches are swept every other day.
The airshow attracted 50,000 visitors to the site plus many more onlookers.
The toilet refurbishment program continues, including improvements made to the Minnis Bay toilets.
Cllr J Cohen
The concerns over tables and chairs placed on Rossetti Gardens by Christies Wine Bar continue. Cllr Cohen has been in contact with Enforcement Officers at TDC who confirm that the owner has been told he must apply for retrospective planning permission.
A lengthy report has been received from the District Solicitor regarding the land ownership problem to the rear of Mill Row. The matter is now with the Residents Association to pursue.
An action group at Yew Tree Gardens are looking for further evidence to support the re-opening of the alleyway to Neame Woods.
14.0 KCC COUNCILLOR REPORT
Cllr C Hibberd
The problems associated with the recycling of plastic and the effect on the environment is being looked at by KCC. A public consultation is to be launched on recycling issues generally.
The Kent Plan 2010 has been distributed, outlining changes and plans for KCC controlled services over the next four years.
Progress on the Yew Tree passageway issue has slowed due to legal interpretation and old documents needing to be found. KCC is seeking advice on what evidence will be acceptable and a decision is awaited before proceeding further.
15.0 CLERKS REPORT
Items of correspondence were detailed including: a letter from a resident requesting information on the ownership of a wall, which youths are jumping over and damaging parked cars. It was agreed that planning permission would be needed to build the wall higher. Replies have been received from Licensing regarding the use of large TV screens outside of pub premises, and from TDC confirming that the graffiti board at the Recreation ground will be cleaned on a monthly basis minimum.
